These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SmartDialog AI LLC, a Texas limited liability company ("Company," "we," "us," or "our"), operating the Rango AI voice assistant service ("Service") accessible at myrango.com and members.myrango.com.
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
Rango is an AI-powered voice assistant service that answers inbound business phone calls on behalf of subscribing businesses, captures caller information, sends SMS notifications, and routes leads to business owners. The Service is designed for small and medium-sized trade businesses including HVAC, plumbing, electrical, roofing, and related fields.
You must be at least 18 years of age and have the legal authority to enter into contracts on behalf of yourself or your business to use the Service. By using the Service, you represent and warrant that you meet these requirements.
To access the Service, you must create an account and provide accurate, complete, and current information including your name, business name, email address, and phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at contact@myrango.com of any unauthorized use of your account.
The Service is offered on a subscription basis with the following plans: Basic ($29/month), Professional ($59/month), and Enterprise ($199/month). Plan features, call limits, and pricing are described at myrango.com and are subject to change with 30 days' notice.
New subscribers may receive a 14-day free trial period. A valid payment method is required at signup. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged.
Subscriptions are billed monthly in advance. Payment is processed through Stripe. By providing payment information, you authorize us to charge your payment method on a recurring monthly basis. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms.
Enterprise plan subscribers who exceed 2,000 calls per month will be billed an additional $0.10 per call above the limit. Overage charges will be added to the following month's invoice.
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the period for which you have already paid. We do not provide refunds for partial months.
You agree to use the Service only for lawful business purposes and in accordance with these Terms. You may not use the Service to:
You acknowledge that use of the Service involves automated telephone communications and SMS messaging. You are solely responsible for ensuring your use of the Service complies with all applicable telecommunications laws including but not limited to the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and any applicable state laws. You must ensure that callers are appropriately notified that their call may be handled by an automated system and that their information may be recorded.
All content, software, AI models, and technology underlying the Service are owned by or licensed to SmartDialog AI LLC and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service. You retain ownership of your business data and caller information collected through the Service.
Your use of the Service is also governed by our Privacy Policy, available at myrango.com/privacy.html, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. SMARTDIALOG AI LLC DISCLAIMS ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL CALLS WILL BE CAPTURED OR HANDLED WITHOUT DEFECT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMARTDIALOG AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless SmartDialog AI LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Harris County, Texas, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy and any other agreements expressly incorporated herein, constitute the entire agreement between you and SmartDialog AI LLC regarding the Service and supersede all prior agreements and understandings.
